Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Our responsibilities

• Murphy Wellness is required by law to maintain the privacy and security of your protected health information.
• We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
• We must follow the duties and privacy practices described in this notice and provide you with a copy upon request.
• We will not use or share your information other than as described here unless you tell us we can in writing. You may change your mind at any time in writing.

How we may use and disclose your health information

Murphy Wellness may use and disclose your health information for treatment, payment, and health care operations. Examples include coordinating your care, submitting claims to your health plan, obtaining payment, improving quality, training staff, managing the practice, conducting business operations, and maintaining records required by law.

We may also use or disclose information when required or permitted by law, including for public health activities, reporting abuse or neglect, health oversight, judicial or administrative proceedings, law enforcement requests, workers’ compensation, certain government functions, organ and tissue donation, medical examiners or funeral directors, and to avert a serious threat to health or safety when allowed by law.

Your choices about certain disclosures

For certain situations, you may tell Murphy Wellness your preferences about whether we share information with family, close friends, or others involved in your care or payment for your care. If you are unable to tell us your preference and we believe sharing is in your best interest, we may use our professional judgment as allowed by law.

Uses and disclosures that generally require your written authorization

In most cases, Murphy Wellness will ask for your written authorization before using or disclosing psychotherapy notes, using your information for marketing in a way that requires authorization, or selling your health information. If you give authorization, you may revoke it in writing at any time for future use.

Your rights

• You may ask to inspect or get a copy of your medical record and certain billing information.
• You may ask us to correct information you believe is incorrect or incomplete.
• You may request confidential communications, such as asking us to contact you in a specific way or at a specific location.
• You may ask us to limit certain uses or disclosures. We are not always required to agree, except in limited situations such as certain disclosures to a health plan when you have paid in full out of pocket.
• You may ask for a list of certain disclosures we have made of your information.
• You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
• If someone is acting for you through legal authority, that person may exercise your rights where permitted by law.

Substance use disorder records

To the extent Murphy Wellness maintains substance use disorder patient records that are subject to 42 CFR Part 2, those records will not be used or disclosed for investigations or legal proceedings against you except as permitted by law, such as with your written consent or a valid court order and subpoena where required.
